Fed: Court case paves the way for DVT litigation

A landmark Melbourne court decision has been hailed as a victory for 500 sufferersof so-called economy class syndrome.

The decision was part of a test case involving Sydney man BRIAN WILLIAM POVEY, whosuffered deep vein thrombosis after a long-distance flight two years ago.

The 59-year-old was hospitalised after a three-day return business trip from Sydneyto London and no longer works.

He's brought action against Qantas and British Airways.

Yesterday, Victorian Supreme Court Justice BERNARD BONGIORNO rejected the airlines'argument they were only responsible if Mr POVEY'S injuries were caused by an accident.

Mr POVEY'S lawyer PAUL HENDERSON says the judgement is a victory for hundreds of other litigants.

He says the 500 plaintiffs in the action are now in a position where their cases canbe determined on their merits.
